ILR Tier 1 retire before ILR?

Post by Rooroo » Thu Jul 16, 2015 7:23 pm

I'm here on a Tier 1 (general) visa and can apply for ILR in April 2016. I hate my job and will have earned enough to meet the earnings requirement by the end of 2015. I'd love to retire then (I'm 60) but that will mean I'm unemployed when I apply for ILR. Does that matter as long as I meet the Tier 1 requirements?

Thanks!

You will have to prove your previous earning from last 12/less months when you apply for ILR.
It will be more than three months gap and the Set(O) guidance says,
This must be the most recent payslip. It must be dated no earlier than one calendar month before the date of the application.
Think about that?

I thought the earnings requirement was the same as for Tier 1 renewal - meet the minimum in 12 of the prior 15 months, which I can. I missed the part about showing a payslip that less than a month old. I'll check on that. Thanks for the pointer!

The less than one month old payslip requirement is for Tier 2, not Tier 1. So maybe I'm ok? Still risky I guess...

Tier 1 to ILR - Do I have to be employed when applying?

Post by Rooroo » Tue Sep 01, 2015 8:49 pm

I'm going for ILR in March but am losing my job in January. I'll meet all the Tier 1 ILR requirements, including income, so my only worry is that I won't be employed at the time of ILR application. Does that matter? I can't see anywhere where it says anything about being currently employed.

Thanks!

No, it doesn't matter as long as you meet the earnings requirement.
