getting parents into UK through EU country

Post by Tire1Questions » Sat Sep 12, 2015 1:01 pm

hello all,
I have just applied for British citizenship and I hope to get it in next 2 months. my other brothers are also in UK on tire1 visa. my parents are in India and are very old. I wish to get them in UK. What are my options?

I have several properties in UK and getting decent rental income. I also have a Company that I can move to any EU country if required and than apply from there for my parents. Do any of you know which is the easiest country to get visa for them? If I live in a EU country for couple of years, can I being my parents to UK using EU treaty rights?

any help is highly appreciated.

1) What languages do you/parents speak - any European ones?
Possibly Ireland.

2) Possibly - if you meet all requirements at the time

2a) - assuming UK is still in EU in its present form post 2016-referendum & any consequences, circa 2018 or so.

On that basis, unless you or they have any strong ties to any other EU country they may be happiest in an English-speaking country such as Ireland.

thanks.
How long would I have to live in Ireland so my parents could be eligible to come permanently to UK in as per current UK immigration law?

I haven't walked this path.

The specific time period is not defined in hard & fast rules.

Note SS is all about switching your status to that of an 'EEA national' so that free movement/treaty rights & EU rules (not the UK Immigration Regulations) come into play.

Posters in forum talk about periods from 3-6 months plus; it probably depends on how organised you are & how smoothly relocating your centre of life into another country actually goes.
Don't forget you've got to literally uproot & go.

Here's an example of Surinder Singh in action (but for a spouse not parents):

- you can find other recent ones if you search the EEA forum too.

I would say that you can go for any EEA country as it sounds like they would have communication issues in whichever country you choose.

If you were to go down this route, you are not governed by UK Immigration Rules, but by the EEA Regulations (EU law).

At the very least, you will have to spend more than three months (treaty rights only kick in at three months).

The UK also requires you to prove that you have moved the "center of your life" to the other EEA country for you to qualify as a British citizen returning after exercising treaty rights.

The first post of the thread posted by noajthan shows the amount of detail that is required to demonstrate that you have moved the center of your life to the other EEA country.

In one of your previous threads, you mentioned that you are married. Moving the center of your life will require the whole family unit to move (wife, children, etc). So, if there are children, for instance, you would want to plan the move such that it does not impact their schooling, etc.

For more detailed information, search for the "Surinder Singh Route" on these forums and on Google.

Also, I believe that this thread would be better suited for the EEA Applications forum in the UK Non Tier section. Could the mods look at moving this thread if they agree?
