worried re visa app......................

Post by ccocolese » Fri Nov 23, 2007 1:27 am

I'm a UK citizen, I met my fiance last year on a trip to the US. He's Domnican and has been overstaying on a visa in the US for a number of years.
We'd like to settle in the UK.Shortly we are going to begin the visa application process. We plan on marrying before we apply.

How will his overstaying affect the application? Is it reason enough to be denied, solely because of this?

Are they likely to ask us ( at interview) if he was working in the US, and if so again would this be a reason for refusal?

If they realise he has broken the immigration laws of one country then it might affect his application to the UK, yes.

He can't apply from the US anyway.

Thanks Victoria

We realise he can't apply from the US. We are travelling to the DR in Jan to start the application.

Can anyone else give any advice on the situation?

We have a baby due in August and I'm really really worried about this. The worst case scenario is he is refused, and we settle in the DR whilst appealing, but I have a well paid job, house and security in the UK.
