ILR Dependent visa application for family living in India

Post by mitosis11 » Sat Dec 12, 2015 11:32 pm

please forgive me if I am asking the same question again as I am not getting the final concluding answer reading all thread :
my question is I have got ILR status after Tier 1 visa, now I wanna apply visa for my wife , can any one tell me which category or type I should be applying ????????? she is living in pakistan. Any one who got visa as of same situation of mine ?? she is outside UK in Pakistan , still I need to apply as settlement.
I read few post commenting that those who had ILR following PBS system cannot apply for spouse as
settlement but shud apply as dependent. But I did not see any conclusive comment about that as I also
Got ILR after Tier 1

This will only apply if your wife has been in the UK as your dependent on Tier 1 G.

If you wife has never been in the UK as your dependent and you now have ILR, she can only apply for spouse settlement visa. Your previous Tier 1 G status is irrelevant in this case.

Yes it is settlement/settlement/wife and don't forget to pay the health surcharge before submitting the application. She needs English A1 from one of the approved test providers for the spouse visa, see the list here (click), page 6 for Pakistan. If she has a degree, she can see about applying for the NARIC assessment.

Do you meet the financial requirement of £18,600pa?

Also, there is a different process for documents for applications from Pakistan. See Update of Spouse Visa Applications from Pakistan (click)

Some useful information is in this post too, see Settlement Visa from Pakistan - Useful Information (click)

Fee is around £1500 and granted for 33 months, and then same again in 2.5 years time.

£956 visa application fee for a 33 month visa (likely to be a 30 day visa and she will have to collect her BRP within 10 days of arriving in the UK)

£600 immigration health surcharge fee that has to be paid before submitting the application.

Please advice me urgently regarding few questions in my mind :

I am currently booked a 2 bed room in which I wanna move later , can I apply visa for my wife on basis of a letter given by company of new house that I have rented this and will be moving later, or I had to be physically present there and have couple of utility bills or council tax ( which may take one month or more ) to get. I wanna move later to save money as new home will be more expensive.

second question is property inspection report mandatory for spouse visa? how to get that ??

Please give me urgent response

Property inspection report is not mandatory, you don't need it. You need tenancy agreement.

Your plan might work if you have all the paperwork and it can be verified if HO wish to check.

House inspection report : ? Mandatory ??

Post by mitosis11 » Wed Feb 03, 2016 7:25 pm

I have rented a newly built 2 bed room semidetached house from a company. I have given part payment of advance and will pay rest 14 days before moving in in March 2016. Its a brand new newly build modern house. Now I am going to apply for my wife visa. Does its mandatory to have house inspection report. or can a company write its own report or letter describing its utilities. The reason I am asking as I am still not moved there and wanna apply visa now bt don't have keys to have access for the surveyor to write this report for me. Please any one having information for that. My solicitor says its essential and wanna charge 80 pounds for that only problem company is not letting any one to do inspection till I am physically moved in March so its causing a delay. I have got draft of rental tenancy agreement.

If the property is for your exclusive use, you don't need to submit a property inspection report. Submit a copy of the tenancy agreement.
