English Rule update

Post by GurmeetGulati » Mon Dec 14, 2015 5:43 pm

Hi,
I need to apply for ILR next month via Tier 1(General) with my family.
Following is the immigration rules change effective from 19th Nov 2015.
https://www.gov.uk/government/news/immi ... es-changes
ensuring indefinite leave and naturalisation applicants, who normally rely on an English language qualification, take a secure English language test

Also, English requirement is updated to:
a printout from the points-based calculator with the equivalent level of your degree and the level of English
from
A print out from the points-based calculator confirming 10 points for the given qualification

Does this means now need to take English language test?

Can someone please clarify this. Really appreciate your help.

Thanks.

Do you have a degree that gives you 10 points for English? Your post is a bit general, you need to be a bit more specific. Also, there are many threads about this.

You can read FAQs English Language Requirements for ILR (click)

Thanks for your quick reply.
Point Based Calculator is giving 10 points for mine as well as my wife's degree.
Is it enough for proving English along with original degree?
Or any of changes in rule mentioned in my last post need to consider?

Also, English requirement mentioned in the FAQ provided by you, states:
A print out from the points-based calculator confirming 10 points for the given qualification

Whereas now it is updated to:
a printout from the points-based calculator with the equivalent level of your degree and the level of English

It will be great if you can explain the meaning of "level of English" in above sentence. I am not getting this. :(

Thanks.

What matters is that PBS calculator should show 10 points for English language. Period!
PBS calculator offers only one kind of printout .... take it or leave it!

I am in a similar boat mate.

I can not see Employer's letter for absences in the list.
Knowing,

How many days you were out of UK during five years?
Maximum days out of the UK in any one year?

, would help.

Just an opinion, cohabitation documents are better if they roughly cover period from your last grant or last two years.

Proof of absence

Post by Gurmeet Gulati » Wed Dec 23, 2015 2:58 am

Hello,
I am going to apply for my ILR. I read in the forum about employers letter for proof of absence, which should state that person is in continuation employment during holidays outside UK.
I am on Tier 1(G). Is it necessary to provide such document for ILR?

I came to UK in Jan 2011 and went back to India in Feb 2011 (Basically, to search for job and got offer).
Then I came back to UK in Apr 2011. So from Feb 2011 till Apr 2011, I was not employed in UK.
Even if I try to arrange for such letter from my previous employer, he will write letter about my employment from Apr 2011 and not Jan 2011.

Or just list of holidays spent outside UK, on a sheet of paper, will do?

Can someone please help.
Thanks.

Keep your ILR queries in a single topic.

So, what should I do:
Explain in cover letter about this? OR
Apply for ILR after Apr 2106?

Can someone please help.
Thanks.

Moderator: I was putting all my queries in same page but with different heading. Let me know if this is wrong and sorry for that. But can someone please help in this. My appointment is very near now.

But have you read the FAQs or the associated immigration rules (mentioned and linked in there) that are relevant to your immigration category?

Gurmeet Gulati,

From what I understand, if you mention this in your cover letter, it should be enough.

Hi Gurmeet,

I have pretty much similar issue.
Following are my dates:
Date of First Entry into UK: 5 Feb 2011.
Date travelled out from UK: 4 Mar 2011
Date arrived back in UK: 17 Mar 2011
Date travelled out from UK: 19 Mar 2011
Date arrived back in UK: 7 Apr 2011
Date travelled out from UK: 9 Apr 2011
Date arrived back in UK: 2 May 2011 – After this date, all travels are made under Paid employment.
Started working: 18 July 2011

I couldn't figure out from FAQs and Guidance document on calculating continuous residence period. More information is in my post http://www.immigrationboards.com/indefi ... 00073.html

To be on the safe side, I am thinking of applying in April 2016.
Please let me know if you get any update or clarification.

Thanks
R

Hi Guys,
Thanks for all your help and suggestions.
I went in person and got ILR yesterday.
They didn't consider about unpaid leave. They are not considering any unpaid duration but just 12 month salary.
Following are the documents I submitted and it took 2 and half hour for me and 2 dependents:
Set (O) + Photograph + passport + BRP
Cover letter
12 month bank statement
Salary slips
Annual leave letter from current and previous employer
Employer letter

Dependent:
Marriage Certificate + Birth Certificate + Degree certificate

Cohabitation:
Electricity bill
Dependent bank statement
Letter from GP
Residence letter
CC bills
Hospital appointment letter

Thanks,
Gurmeet
