Tax issue ILR

Hope you all are fine

I got Tier 1 general 2011 April ,I have shown £42000 income from self employment I had income from employment £10500 too which were not shown to HO but declared to HMRC (I wanted £35000 income to qualify) , 2013 did my extension under employment and paid tax on that , and I am going to apply for ilr in march 2016 , my Tax details incomes are as Follows

2010/2011 self-employed income £42000 Paid tax on that (INITIAL APPLICATION )
2011/2012 salaried income £13500 and loss on self employment £8500 got refunded
2012/2013 salaried income £39000 paid tax and got TIER 1 EXTENSION
2013/2014 salaried income £9440 paid tax
2014/2015 salaried income £10500
2015/2016 salaried income £39000 and paying tax (ILR)

I am salaried on my own company where i am a director

my question is

1, I couldn't earn £35000 five years continuously also i got loss in 2011/2012 period , do I want to earn 5 years £35000 or more , and also i have some mistake on tax record with HMRC which i have contacted and waiting respond from HMRC,Can anyone clarify this issue please

Hi Rafee,

The answer is NO, you dont need to earn 35K for all 5 years.

Dont take it personally your earnings in last five years are looking so shabby, I am NOT saying you have done something wrong, but as a common sense, how come whenever you are going for extension your earnings suddenly hiked to 35K + and right after the next year it goes down to below 20K.

Hi All, Asking on behalf of a friend.

A friend of mine is in the process of tax amendments 2009/10 which is beyond 4 years. His accountant has sent an amendments to HMRC in July 2015 and still waiting for any updates however, his accountant informed him today that HMRC may not update his tax. Due to some family issues my friend applied for 2nd extension this April so visa expiry is 2018 but ideally would like to apply ILR soon.

What are the options for those who can't Amend tax?

Thank you very much for your answer khan , I have not done any kind of Fraud in this matter but as you said its fact when someone looks this details ,they will mistake , What do you think , can i apply with this earnings , do I need change anything please advice me , can they reject my application on this basis

High risk of refusal for ILR so trying to fix income/self employed income/tax that wasn't declared previously. Cannot hide from the tax man or HO for that matter....

Because suddenly they realised that the 'gamble' they took 5 years ago is not worth it.

Because of sudden change of hearts by UK Tax payers have now alerted HMRC. HMRC are now waiting for change in policy before processing further amendments. Decision for tax returns older than 4 years have been put on hold until this 'guidance' received.

Does anyone know once the new 'policy guidelines' arrive, if HMRC will start processing the expired returns (from 2011 and older)? What might possibly change?
