Hi everyone

I would like to take some information regarding my wife indefinite leave to remain

My question 1)
My wife came to UK in september 2011 as a dependent of my tier 1 general. Then she got FLR M visa on november 2014. Because i had indefinite leave to remain on march 2014 on long residency.

When can she apply her indefinite leave to remain
What i heard if she spend 5 years with me as a dependent then she can apply her indefinite leave to remain

She will only qualify for ILR after 5 years on FLR(M) - 2 x 2.5 year FLR(M) visas, so she can only apply for ILR in 2019. She cannot combine her time as PBS dependent with FLR(M) to make up the 5 years.

The rules changed in April 2014 regarding PBS dependents when the main applicant obtains ILR based on 10 years long residence. She has effectively lost the time that she has already spent in the UK as PBS dep (unless she reaches 10 years long residence)

Well i spoke to home office they said to me as far as your dependent spend 5 years with you she can apply ILR.

Secondly two of my freinds Wife got ILR in same category..

One got in november 2014. On window PEO his wife came on psw in 2011 then he got ilr on long residency in 2014 then he applied his wife ilr on november 2014 she got it.

Second got in 2015.his wife came in 2011 as well.


And i spoke one of law firm as well 2 days ago they said to me yes she can apply ILR ONCe she spent 5 years with main applicant but have to show 18,600 income.

I am just little bit confused . Please reply.

Your friends were lucky. You wife may also be lucky.

However, if a caseworker refuses to grant ILR in accordance with the changes in the rules, then there may be little/no grounds to refute the refusal.

What should i do now. Should i apply . As home office , immigration lawyers saying same thing she can apply because she came before july 2012 so she can apply.

Kindly explain your last line i couldn't understand. Please reply

Basically, she doesn't qualify for ILR. If she is not lucky and the caseworker refuses her application, she will have no grounds to appeal or ask for admin review as the refusal will be correct in line with the rules that came into effect in April 2014.
