APPEAL FOR EEA FAMILY PERMIT

MY FAMILY WERE REFUSED AN EEA FAMILY PERMIT FROM OUTSIDE THE UK.. I AM LOOKING TO MAKE AN APPEAL AGAINST THE DECISION, IS IT BETTER TO MAKE THE APPEAL TO FIRST TIER TRIBUNAL IN THE UK OR TO MAKE IT TO THE BRITISH HIGH COMMISSION IN THE COUNTRY WHERE THEY WERE REFUSED? AND I ALSO WANT TO FIND OUT ABOUT THE APPEAL PROCESS. WILL I HAVE TO SEND ALL DOCUMENTS WHICH WERE USED IN MAKING THE VISA APPLICATION WITH THE APPEAL NOTICE OR DO I ONLY NEED TO SEND SUPPORTING DOCUMENTS REGARDING THE REASONS OF REFUSAL? YOUR HELP WILL BE GREATLY APPRECIATED GUYS...

What was the reason for refusal?

Is this the application for your brother(s) or mother from Nigeria based on dependency on your EU partner??

I am sorry for posting in capital letters. They have refused the application stating that they did not see any compelling reasons why my brother and mother are dependent us.. despite that fact that it was explained in the application form and cover letter that my mum has been unemployed for over 15 yrs and have separated from my dad and that my two brothers live with her,hence the need for me to support them.. They also made mention of the fact that their birth births were registered years after their birth and that he is aware that these documents are easily acquired in nigeria. this is ridiculous as it is very possible to register birth in nigeria several years after your birth as long as you acquire an affidavit from your local government. I believe the appeal can be won. Should i do a paper or oral appeal/ and should i only submit documents relating to the reasons of refusal with my notice of appeal or every document used in making the original application? pls advise me

What have you submitted to prove dependency?

Financial help is not sufficient, this was already advised and explained to you in your previous thread.

retained right of residence or permanent residence card?

Hey guys. i need your advise. i have been married to my EU national sponsor since oct 2012. it should technically be 5yrs this october when i should qualify for permannet residence. If i initiate divorce this month- july and possibly the divorce proceedings end just after october, and able to provide evidence of my EEA national exercising treaty rights for five years, will i qualify for permanent residence or retained right of residence? also, will i need to provide my EEA national Identity if i were to apply for either ROR or PR after the divorce?. please note that i have been issued RC since 2013.

How did the appeals go?

You can certainly divorce if you meet the requirements in Regulation 10.
