PBS dependant and ILR - 180 days rule

Hi,

I would really appreciate it if someone can help. I am holding a Tier 2 (General) and should be able to apply for ILR in May 2015. My wife has been an dependant with me since 2011, but she was absent for 180 days last year. Does she need to qualify the continuous period for applying for ILR with me at the same time? and what rule for the dependant to apply for ILR. I have read some relevant posts but wonder if the rule has changed and what the latest update would be.

No she does not. Rather, absences should be 'limited and for good reason'.

Many thanks for your reply. Can you clarify the absence rule (limited and have good reason) is for the main applicant or my partner as well? Does my partner need to provide any documentary evidence of absences on application?

Limited and good reason for the dep. A PBS applicant should not exceed 180 days absence per 12 month period. Evidence should be for the good reason e.g. Maternity.

I am in a similar situation.

I got ILR in Sep 2015

I posted this but did not get satisfactory replies.

Wife and son are in the UK. Wife might be eligible for ILR as she entered UK in May 2011.

But she was out of UK for maternity, care and rest for 10 months in India (Nov 2013 to Sep 2014).
Baby born in India in Jan 2014.

I spoke to couple of solicitors and they said it could be risky but wife and son could be granted ILR.

I would like to know any similar real life experiences anyone heard of.
