Help with ILR for non EEA

Hello guys, hope someone can give me some advice as I have just 4 months left to apply for my ILR and I am not sure if I qualify. I am from Brazil and I have been living in UK for almost 10 years, the first 4.5 years I was here as a student and then in april 2003 I got married to an EEA national and got my 5 years residence, which will expire in May 2008. Our marriage was not working well and about a year ago my wife left me and went back to Spain, her country of origin but we are still married and did not start any procedures for the divorce yet. I read in the HO webpages that it is possible to a non EEA to keep the residence in UK in cases like this if the non EEA have strong roots in Uk, like employment for example. I work full time and can prove I have been working for the last 7 years also I am studying and have never used any resources from the public fund nor have I ever overstayed or have any visa refused before. Do I qualify for apllying for the IRL without my wife? And if so, how can I do it? Which form shall I use?
Any help wold be highly appreciated.

Possibly - but you may need a good immigration lawyer.
Are you divorced from your EEA spouse?

No, we are not divorced. We are not talking very much nowadays and did not even started the procedures for divorce yet.

It may be because none of us knows, we are mostly ordinary folks who've been through the immigration mill in some way, certainly not seers, oracles, visionaries or even solicitors.

Have you tried an immigration lawyer or consultant?
