Dependent Visa extension - tier 2 and now on ILR

Hi,
My wife entered UK as my Tier 2 General dependent in Feb 2014 when she was granted a 3 yr dependant Visa. I have obtained ILR in June 2015 through 5 yr tier 2 route.

What visa should my wife apply for her dependant visa extension? Should she apply for flr m now and then apply for ILR when she completes her 5 years? Or should she apply for Pbs dependent extension. Just to clarify that I am on ILR through 5 yr route now.

Will applying for flr m reset the count and her stay would be counted from flr m visa start for next 5 yrs ?

What do you suggest ?

What is the form and documents required for the required visa?

Your wife can apply for a Pbs dependent extension as you were granted ILR under the 5 year route.

Thanks for the reply. I was looking for the form in a separate thread but it seems the form is just for tier 1 and 5 dependants.

I cannot find pbs dependent visa extension form for tier 2 general dependent. The form I can find is for tier 1 and tier 5 pubs dependents only https://www.gov.uk/government/publicati ... -dependant

1. Can you share the form for pbs dependant extension
2. How do I fulfil her maintenance requirement? Will a letter from company that sponsored my tier 2 general work as I am now on ILR ? I still for the same company.

Tier 2 Dep is an online application. You have to prove maintenance as far as I am aware.

Hi thanks for your help so far.

Just to get an idea of what formalities and proofs I need to provide for tier 2 pbs dependant online application I started filling the form step by step.

1. For Maintenance I selected that my sponsor will not provide maintenance letter for my wife's application and the form accepted that. The application also asks if the main applicant is on ILR now and I selected yes which is good. Later for maintenance it gave option of providing bank statement with sufficient funds and I selected the option. So maintenance fund requirement is sorted.

2. I now have issue with IHS surcharge step. When calculating IHS surcharge that I need to pay I filled following detail

Visa Route: tier 2 pbs dependant ( or should I select PBS Dependant tier 1,2 and 5)?
Visa type : tier 2 general upto 3 yrs ( although I am on ILR now)
But the problem is while mentioning visa expiration date. If I mention ILR end date that would be 10 yrs. my initial tier 2 general is no longer valid and was ending in Jan 2016 but I got ILR in June 2015 itself.

Does my wife need to pay IHS surcharge in the first place ? If yes then what details should I put. Remember I need her visa extended for another 2 yrs at least so she can apply ILR on completing 5 yrs.

Immigration Health Surcharge was introduced in April 2015. She has to pay it and it should be £600 for 3 years.

She applies alone. DO NOT put your ILR details in as it will tell you to pay more.

All selections should be Tier 2 Dependent.

I was selecting on the first question

Are you :
Applying to join someone

Instead I think I should select
Are you:
Applying alone ( it doesn't ask visa expiration date of main applicant in this case)

And then

Visa route : tier 2 PbS dependent
Visa type : tier 2 general upto 3 yrs

Yes it now calculates £600 now.

So once I have completed the application online and paid IHS fee online I should send the application form with documents and photograph by post.

What is the pbs dependent fee on top of the IHS fee ?

Looks like there is no English language requirement.

1. Is confusing...you mention 'asks if the main applicant is on ILR now' . Your wife is the main applicant. You are her sponsor.

'Apply to join' was not correct as she is already in the UK. Apply alone is correct.

Fee is £664 if applying by post or £1164 if applying in person for same day decision.

Fee for Tier 2 shortage occupations upto 3 yrs applying within UK is £428

So total fee for my wife's application would be 428+ 600 ( IHS surcharge) = £1028 ?

I can't see 664 as fee anywhere.

The link you have provided is from 2014 and for applications made OUTSIDE the UK!! The fees have increased since then. I quoted what was in the first link I provided in my first response to you.

Hi,

Thanks for your help so far..
I am filling the for of my wide for PBS dependant extension now. The only issue I am facing is while putting My Visa expiry date for IHS Surcharge calculation. I am now on ILR from Tier 2 General route. While putting my Visa expiry date (to calculate number of years of stay or IHS Surchage duration), if I put my ILR Visa Expiry date it will be 10 years and would require to pay more, but I need my wife's visa extension or IHS surcharge for 3 years.
What should be my Visa expiry date here ? (Remember mi Tier 2 general visa has expired and ILR is for another 9 years). Shall I make up any random date 3 years from now ?

She must 'apply alone' and you must not put your details in. IHS should only be £600 for your spouse.

I can't see any option of 'Applying Alone' anymore. It asks are you joining or staying with someone in UK initially in the form."You're joining or remaining with this person in the UK"

Also it says in the IHS Surcharge calculation form that : "The information taken from your visa application can’t be changed or removed. If you’d like to change or remove this information you must start your visa application again."

Hence it picks main applicant's details from the main Visa form. the Main Visa form asks for details of the applying dependant and also for the main applicant, who is being joined or stayed further with.

What should I do ? I am filling the form now and need to submit it ASAP.

Wife is main applicant. You should not put your details as only she is applying. I believe there should be a tick box to state you have ILR or are BC.

Which visa or permission to stay has Mr Akhilesh xxx applied for or been granted?
Choose the service that the PBS main applicant most recently applied for, even if their application is still being processed. If the main applicant has been granted indefinite leave to remain or British Citizenship, you should choose the PBS Tier under which they were granted leave before.

Also My wife's Visa expires on 23Feb 2017. Can I apply for Visa on 30 Dec 2016 ? Does the Visa extension application date need to be less than 28 days before the expiry date ? Will it be refused if I apply 7 weeks in advance ?

For IHS Surcharge, I can pay it separately and select that my wife is applying alone and pay for 3 yrs. I can then provide the IHS number separately while filling the form.

You can apply at any point, however just be mindful that she needs to achieve 5 years residence from date of first ENTRY to the UK and if you apply too early, she could end up with a shortfall and need another extension.

Yes on the IHS issue, which is how others have done it.

My wife has completed 3 yrs in UK under first PBS dependant Visa. I am now on ILR. She has paid IHS surcharge for 3 years for het PBS dependant extension now. Won't she get 3 years extension now ? If she gets 2 yrs extension then she would shortfall 5 yrs by 2 months. But I expect her to get 3 yrs extension as I am on ILR now and IHS surcharge she has paid is for 3 yrs (£600).

Please suggest I am applying today ...
