Indian Spouse to UK Settlement Visa - Category B ?

Indian Spouse to UK Settlement Visa - Category B ?

Hi,

I hope someone can help.

Can anyone let me know what category I should sponsor my wife for her settlement visa (she is coming from India to England,UK)

My salary earnings so far:

April 2013 to April 2014 - £21,000 (My P60 Says this) - Working as Employee

May 2014 to June 2014 - £3200 total (£1600 a month) - Working as PAYE Employee of Company & I was registered as Director/Shareholder.

July 2014 - Present - £3200 total (£1600 a month)- Working as PAYE Employee of Company - I am No Longer registered as a Director/Shareholder - My friend is now complete shareholder.


Am I ok to apply under Category B by showing last 12 months of Salary and current Salary, showing my current contract as an employee?


Or would the fact I was a company director for 2 months in May/June 2014 make an issue with UKBA?

Would they request to show accounts for those 2 months I was a director?

When I apply, if they were to check with HMRC, I would be classified as just an Employee now, since I was only a director for 2 months. I am now just an Employee on PAYE.

Or Should I wait until I have a full 6 months salary at my present employement?


Any advice appreciated.

You can apply under Category B as long you mert financial requirement of 18,600 in your previous 12 month and there will be no problem of director employment... Hope this will help..

Are you definitely sure those 2 months as a director won't be an issue?

I know that when the application is submited, I will have at least 3 months wage slips in my current employement as an Employee (5 in total if you include the 2 as a director/employee)

Its just that these UKBA people seem to suggest that if you are an employee on PAYE, and a director of the company, you have to apply as self employed.

My case is different, as I was only a director for 2 months, so not sure if they would flag it up when the application is sent through to them.

That is applicant choice to decide whether to apply under self employed or salaried employed . If applicant decide to apply under self employment then he has to wait till the end of tax year to file tax return..... In your case there will be no problem according to my experience...

i definitely dont want to apply under self employment, which is why I am not sure whether I can include those 2 months I was employed while also a director.

Do you think they will notice that I was a director for those 2 months or simply look at the up to date records at the current date of application?

I'm not sure whether to exclude those 2 months entirely, just can't trust these idiots at UK Home office, they come up with any excuse to shaft you.

Don't worry bro.... U can apply under salaried employement as long you meet financial requirment. If you still have doubt, then attach a covering letter with your visa application explaining everything to ECO. Hope this will help you.

Hi thanks, i admire your positivity!

But I just can't trust the UKBA to check basic facts!
they make many mistakes, even with factual documents.

If i apply under category B, showing less than 6 months employement at my current employer, I have my full 12 months bank statements, wage slips for the past year.

Its only the 2 months as a director which are risky and causing concern. I wonder if anyone else has a similar situation?

I could try, and basically hope they simply check the 12 months salary and thats it.
The taxman will verify my earnings, just not sure if they will pick up on the fact of 2 months out of 12 being a director whilst on PAYE employement.

Hi do any of you guys know if the ECO in India ever gives you the opportunity to supply a missing payslip? I could not submit my december payslip because it was issued when i was in India getting married

In your experiences would the ECO give me the chance to send that payslip? Or would they simply refuse it??
