Hi all, I have a big question about my wife visa. Can Anyone give me advise please.
My wife came to UK on student visa on 10th Sep 2007 and left the country on 30th March 2010 when her student visa Expired. Then She came back to UK on My Spouse Visa on 9th August 2010 Just after 135 days.
Now can She Applied for Indefinite Leave to remain on 10 years residency Element in August 2017 even she left the country fo 135 days.????

Yes, provided that she left the UK with a valid visa, i.e. it had not already expired. She also must not have any absence of 180 days or more.

As par my previous post I visited 2 solicitors for further clarification and 1 said if my wife applied visa within 90 days of leaving UK in 2010 then she can apply ILR on 10 years residency and other said If she has applied within 28 days of leaving UK then she can do that otherwise she does not meet the requirement of Continuity but in both cases she did not apply in 30 days. Actually She applied after 125 days and got her reply in 10 days and came here.
Please advise again what should she needs to do? Should she apply ILR or go for extension.

I applied on 3rd Feb and fees was deducted on 9th Feb but haven't had acknowledgement/bio-metric yet

Dear Gurus,
I am currently waiting for my Tier 1 Ent Extension for last 4 months now i want to go for premium service via SET (LR) in next 15 days. BUT i am confused about my dependent how can i vary her application.
Shall I go for mine 1st then get an app for her FLR (FP)?
OR
Shall I book 2 appointment on the same day?
Please seniors help!!

Hi
Applied for wifef's ILR (10yrs, Long residence) in first week of September. bio-metric done already in September 2016.
As it is over 6 months she called home office to inquire about the delay and was told that there is no delay. They are processing the applications received in November but somehow not taken any decision on her application done in September.
They were not ready to say anything else like do they need any more info or document from us.
Does anybody else has similar experience or can anybody help.

Is it not possible to ask your MP to get involved with your wife's application? I applied on the first week in November and have not got any outcome from the HO. It seems that the HO will use all the 6 months period to process the application.
Could you please share what documents you submitted ?

Yes we are thinking of getting the MP involved. Lets see what happens then.
I don't remember on top of my head but for 10 years i think we attached the Passport, old biometric, Life in UK test cert, degree cert and couple of other docs. Sorry I dont remember all of them as it was while ago.

19/9/16 application 10 Year route with no gaps and no breaks
28 sept BRP letter received
4th Oct BRP submission
28th Oct Letter received from HO as usual takes 6 months etc.
waiting ...
10 Jan My Mother expire - wrote a latter to get the result in 5 days. but not successful received a letter on
17/1/17 stating not possible as it has the exceptionally complex issue.
then again waiting...
Please share if someone received a result or waiting time.
It will be very helpful

Can senior members please provide their valuable advice on my case.
Applied for SET(O) ILR in March last year. not received any correspondence apart from Acknowledgement.
2010-2011 amendment was done in NOv 2015 and paid.
I have completed 10 years this month, I have 3 kids Born here, one is school going , age is 6 year.
1- Is that okay for me to go on LR route now ?
2- I heard there is no appeal right on LR(10 year) inside country. in worst scenario how many chances are to secure appeal inside country ?
your advise will be highly appreciated

Hello,
1- Yes, you can apply on LR route. Pls bear in mind you can only apply alone.
2. Wrong. LR applications carry a ROA. It is actually now added to the form, to clear any doubts, I believe.

Hello,
I varied my FLR(FP) to ILR in December 2016. My ILR (SetLR) was approved + BRP sent to me this week. From variation to approval took 3.5 months.

It depends on the visas you have held. If you had Tier 1 G and self employment, then yes, very likely you will be interviewed and/or asked to complete a questionnaire.
