Dependent not eligible for ILR,what Visa should we apply for

Post by suryareddy99 » Sun Nov 02, 2014 4:03 pm

Hello,

I have come to UK on Tier2 ICT in 2009, moved to Tier2 general in 2012 and now i'm applying for ILR.

my wife has come to UK in 2014 so she is not eligible for ILR and her current dependent visa is valid till next year 2015.

Do I need to apply her dependent visa(FLR) along with me or can I wait still next year to apply her ILR dependent visa?

my wife needs to complete 5 years to get ILR, if we apply for FLR will the clock get reset? I read it in one of posts that clock would get reset?.

Thanks

It depends under what category you are applying for ILR.

Assuming that you are not applying for SET(LR) under Long residence:

It's probably best for her to continue and extend as a PBS dependant, until she qualifies for SET(O) under 319E.

Dependent Visa extension for British Citizen(tier2)

Post by suryareddy99 » Fri May 12, 2017 2:49 pm

Hi,

I have got my wife's Visa extended(within uk) as tier 2 dependent when I got my ILR, now i'm a british citizen should i still extend her visa under Tier 2 dependent category?

I have gone through the "Family members of points-based system migrants" document in gov.uk and it says we have to use the tier2 dependent application form to apply for extension but after reading some of the comments in the immigrations boards i'm bit confused, How is PBS dependent different from Tier 2 dependent?

My wife's visa is still valid till Feb 2018, Can i apply for the extension now(7 months before the expiry date) as we have plans to go out of the country in November this year?

Thanks In Advance

Tier 2 dependants are PBS dependants.

Yes. She may apply for a 3-year extension now.

Thanks Vinny,

Can i get it extended only for 2 years as she will be eligible for ILR with in the next 2 years, if i get it extended for 3 years i have to pay £600 IHS charges, if i say my visa is getting expired in the next 2 years i'll have to pay only £400 IHS charges and will also mention in the covering letter that my wife will be eligible for ILR in 2019 Mar.

Will this work?

If you have ILR, a tier 2 dependent extension is granted for 3 years as stated in the immigration rules.

Previously her visa got extended for 3 years and now she needs only 2 years to complete 5 years.

Can i get it extended only for 2 years?
