Received 'Determination' today - what next?

Post by gollywood » Wed Mar 12, 2008 2:44 pm

Hi

As anyone who followed the thread (see below) will know, we were successful in our appeal for a family visitor visa.

http://www.immigrationboards.com/viewtopic.php?t=23643

Just been to the AIT court to pick up my bundle of files, and there was also a letter attached called 'The Determination'

It's a 6 page document, which ends by saying:-

15. I allow the appeal under the Immigration Rules

1) What happens next? What does the 'Appellant' do with this letter when they receive their copy?

2) What is the process from today with regards to getting a visit visa stamped in their passport?

Many thanks!

You need to wait for 10 working days to see whether HO appeals against it. You expect HO to contact you in about two months time asking you to send the passport. Then send the passport and you expect to get it stamp within a week. That's what happened to one of my friend. I would suggest if you are not desperate don't contact HO. I know it is hard to wait but have patience.

2 month wait? Isnt that excessive? How long should we wait before contacting them?

Yes it seems too long. But at first you need to wait and see whether HO appeals against the decision. But what to do, HO always takes too long to implement the appeal decision.

Thanks Raj.

If the HO rep who attended my appeal hearing has any sense, any self respect, any shame - she will advise her superioiors that this is a case they cannot ever win!!!

Sometimes Ho rep takes some ridiculous decision.

Just out of interest ,why was your visa refused?
