Submitting new application after appeal submitted

Post by funnykangaroo » Tue Apr 29, 2008 6:54 pm

Hi there, I have submitted an appeal for a decision made to refuse my daughter a dependant visa. I have now learned that I did not include sufficient documents with the appeal and really need to lodge a new application. Can I lodge a new application while there is an appeal in process, or do I first need to withdraw the appeal. Thanks

27.3 - Appeal procedures at Post when refusal was decided by the Home Office wrote:There is nothing in law to prevent a person who has an appeal pending from making a fresh application for entry clearance in the same or any other category. There is no requirement for a person to withdraw an appeal before allowing a further application to be made. If an appellant is issued a visa to enter the United Kingdom, e.g. following ECM review, then post should follow the procedures as per 27.4.1.

YOu can still submit additional documentation prior to your appeal - they usually ask you to submit it at least 5 days before the hearing.

Really? How do I do that? Is there a form that allows me to append additional documents to an existing appeal?

Which would be faster? Submitting a new application or submitting new documents?

With the new documents, can the Entry Clearance officer grant the visa immediately, or will it have to wait for the appeal to be decided?

It is urgent I get the visa ASAP.

Thanks so much for your help
