Dear members and experts,

I need a massive help on the following matter:

I have a valid Tier 2 general visa (leave to remain) up to 2023 & my family is here in the UK with a valid leave to remain dependent visa till June 2019.

I have applied for extension to my children visa (3 years old child & less than a year old baby) 5 weeks ago. We have decided not to apply to extend my wife's visa as she recently started working in a hospital. She is planning to apply for a separate Tier 2 general visa instead of her dependent one & she is waiting for CoS. This decision is purely due to her career aspirations.

I just received the following email from the home office:

You have submitted an application for both your dependant children for further leave to remain in the UK. I note that your previous applications have included a dependant partner however they are not included on this application.

I would be grateful if you would confirm the reason why they have not been included on this application?

I am unable to reach a decision on your application until I am in receipt of this information and therefore would be grateful if you would supply this as soon as possible via return of this email.


I need your help and expertise regarding how to respond to their email.

Why does your spouse want to apply for their own Tier 2 General which will reset their clock for ILR to zero??

When will the sponsor apply for a Restricted CoS (there is no guarantee a CoS will be approved at the monthly allocation meeting)??

Your children are likely unable to get a visa until your spouse either applies for a dependent visa or returns on a tier 2 general if her visa is approved.

Your children will also not be able to apply for ILR when you do and will only qualify when both parents hold ILR.

The PBS dependent children rules are very clear on the requirements regarding both parents.
