Student to Tier-1, Please help

Student to Tier-1, Please help

Dear all,
I have applied for Tier-1 in May 2008 and havent; recieve any decission from HO. However my student visa is expiring soon on 18th July 2008. Since i sent my passport and all documents with Tier-1 application.
1/ Please tell me that if i refused OR dont get decision from HO before
2/ 18th July or, then what will be my visa states?
3/ Can i apply for the extension of student visa without passport before the decision of Tier-1

1. You have the legal right to remain in UK until a decision is made on your Tier 1 application.
2. If your application is refused, you will be given 28 days to leave the country.
3. I don't think you can apply for extension of student visa without your passport, but I'll let other members confirm this or correct me.

Thank you very much for information.
Do you know, is it possible to apply for further student or IGS visa after the refusal of Tier-1, because i wish to continue my studies/ find job if not succed to get Tier-1.

The following is based on my personal understanding.

If your Tier 1 application is refused and if your current leave to remain as student is also expired by the time you receive Tier 1 decision, then technically you will be an overstayer (no legal staus in UK) and will need to leave the country within the stipulated time. I do not think that you will be able to make any application for leave to remain under these circumstances.

But yes, you could then return to your home country, apply to educational institutions and, upon confirmation of admission, apply for EC as a prospective student.
