British citizenship and overstay

Hi,

I arrived in the UK May 2009 in a student Visa. I renew my student visa in June 2010 but i was refused. I appealed the decision but they still refused my appeal. I appealed in the high court but after that I didn’t received any decision/report for 2 years and 10 months. I got married with british citizen in june 2013 and i went back home to my own country and applied for spouse visa and it was granted. I entered the UK legally. Now i got my ILR. I am planning to apply my British citizenship. Since i came back to the UK I didn’t breach any immigration laws.

My question is does this will affect my application for staying for 2 years and 10 months waiting for the decision?

Simon,

I’m planning to apply British citizenship. I overstayed for 2 years and 10 months while waiting for appeal decision. I am asking if this will the cause of the refusal when i applied British Citizenship ?

Time spent waiting for an appeal is lawful as long you had section 3C. Request an SAR and see what UKVI holds on your file

DO you recall if it was an appeal to the High Court or a Judicial Review application to the High Court? While the former would have extended your leave, the latter would not.

Do you still have contact with your former solicitor? He may be able to assist you with whether it was an appeal or a JR. Did he receive any response to the appeal/JR at all after you had left?

Actually it was appeal on the upper tribunal. Thats the decision that i waited for a long time. Do you think this will affect my BC application? I need you advice guys. Please help. Thanks
