It should be the last 5 years. SET(M) has no absence limit anyway
Hi

My wife is on 5 years FLR M visa. On one occasion, within these 5 years, she has been outside the UK for about 7 months. She is due to apply for SET M (ILR) next month. Please advise if this stay of over 6 month outside the UK will effect the outcome of the application.?

Regards
Ali

SET M - Adequate maintenance, benefits rates calculation

Post by tjespak » Wed Oct 09, 2019 2:20 pm

Hi

My wife is on FLR-M and is due to apply for her ILR (SET-M) next month. The 2nd FLR M extension was granted on the basis of adequate maintenance as we receive Disability Living Allowance for our son.

As we will be applying for the SET M on the basis of adequate maintenance, could someone please advise how to calculate the adequate maintenance by using the current benefit rates as we have the rates from 2015. At the moment we are receiving the following and have 2 children.

Universal Credits
DLA
Child Benefit
Part time self employment for myself

Regards
Ali

Hi

I had this document but it is from 2015. Do we still use these rates to calculate the maintenance.?

Hi

While completing the online form and the finance section, it only gives an option for salaried category. It asks for payslips and the relevant bank statements. I am self employed and there is no option for the self employment documentation to be submitted. As we only have to fulfil the adequate maintenance, could you please advise what options to we have to tick and what documents to submit.? Being self employed, i get paid every week and take my expenses.

Ali

Hi

The question was that on the online application under "Your partners employment income" it only gives the requirements for salaried persons. Please see below the screenshot

I confirm I will provide:

Letter from your partner's employer(s), confirming employment, gross annual salary, annual salary after tax and National Insurance contributions, length of employment and type of employment (permanent, fixed-term, contract or agency)

Payslips for your partner covering the period of 6 months prior to the date of application, or since employment started if less than 6 months

Personal bank statements for your partner covering the same period as their pay slips, showing that their salary has been paid into their account, or an account in your and your partner's names

Do we just check these options but provide the self employment documents.?

Priority Service for ILR on 5 year partner route

Post by tjespak » Thu Oct 24, 2019 5:40 pm

Hi

While completing the online form for ILR based on partner 5 year partner route, it only gives option for Normal service and super priority service. Is there an option of booking the priority service which is not mentioned there.

If you are not getting the super priority option then it means nothing is available. Due to high demand, many cannot and don't get the super priority option lately.

Adequate Maintenance Self Employment Urgent PLEASE

Post by tjespak » Tue Oct 29, 2019 12:15 pm

Hi

My wife is applying for ILR (5 years partner route). The last 2-1/2 years extension was granted on the basis of adequate maintenance as we are in receipt of DLA. So we will be applying for the ILR on the basis of adequate maintenance as well.

As i am self employed just now (since 6 April 2019), so i will be relying on last years tax returns as income. Last year i was both self employed and employed (salaried). This year i am not employed and i am only self employed. Could you please advise if i have to show both employment and self employment for current ongoing income as last year or i can only rely on current and last year's self employment.? As the guidance documents say the following:-

"There must be evidence of ongoing self-employment, and (where income from salaried employment is also relied upon or where paragraph 9(c) applies) ongoing employment, at the date of application."

Please advise.
