Hi all,
I need an advice for my friend who is qualified for ILR and want an advice before sending ILR application. Following are details of his immigration timeline:
1- Tier 4 Student: 29 March 2010 (VISA start date)
2- PSW: July 2012 (VISA start date)
3- Tier 2 (General): 30th June 2014 - June 2017. His salary was 22.5K according to COS.
4- Slaary increased to £33K on 11th April 2017
5- Tier 2 extension applied on 8 May 2017 (along with wife and 3 children) with same employer, but application was refused after waiting 16 months on Sep 2018. The reason was when he applied his salary was £300 short as compared to minimum required for his SOC (£33,300). When he checked online it was £33,000 but later changed to £33,300 (He failed to notice the increase).
6- Admin review submitted on 1st Oct 2018 which was refused on 11th Oct 2018.
7- His salary increased by company on 17th Oct to £36,000 (39 hours weekly hours)
8- New COS allocated and made fresh Tier 2 extension application within 14 days on 24rd October which was accepted
My friend was qualified for ILR in May 2019, now he has passed life in UK test and ready to send ILR application. He want an advice if there will be any problem due to last refusal?
Also his salary was increased 22.5K to £33K right before extension and £33K to £36K after his Tier 2 extension was refused, will this cause any problem for ILR application?
Gurus, please provide advice as my friend already suffered a lot due to refusal along with his family. So he want to make sure he doesn't make any mistakes.
