Spouse Visa Separation

Post by mulan2020 » Sun Jan 05, 2020 10:33 pm

Dear all

I am currently on spouse visa from last 2 years which is going to expire in March 2020.
I have been married since 2016 but unfortunately it is not working any more. Although I am still married, I recently moved out and separation is not official yet and we have not file for divorce or anything. But unfortunately I feel its going to happen soon.
I have been in UK legally for more than 10 years. As I understand I can apply for ILR on long residency route.
I have recently started my online application and there is a question which ask if I am married and living with my spouse.
I understand I have to inform home office when we officially get separate.

My question now is " 1- can I inform home office that my relationship has ended (by sending home office relevant forms and letter) and soon after that apply for my ILR based on 10 years route and by declaring my relationship status as ended on ILR application?

2- When I inform home office that my relationship has ended, will I have to wait for their response before applying for ILR application or can I immediately apply like after 2 or 3 days after informing them?

3- I have been staying in UK legally without any visa gaps and have been getting visa extensions without any visa rejections in past, I am just worried that could going down this route might cause complications in terms of getting ILR?

I would really appreciate your help and guidance regarding my questions and my situation.

Many Thanks

It is a reportable change of circumstances per se, however, even if your leave is curtailed, you have 10 years residence now. I suggest an email to the HO reporting the change and make your application.
