WP1 Rejected on 31st July (Appeal)

Hi,

My employer submitted the WP1 on 9th June got inquiry on 24th July and rejection on 31 July.

Inquiry on 24th July asked for the detail specification of job roles and responsibilities o of the job, Hence we have sent them by fax it as well as post it.

My Background:- MBA (2005-2006) from UK, working as a Recruitment Consultant (IT) since 2006 till date with current basic salary: £20,000 K

Reason for rejection (31st July):

Thank you for your application to employ ******who is
currently in the United Kingdom.

I am sorry to inform you that from the information provided, we are unable to approve the application for ******.

Why we have made our decision?

The following shows where you have not demonstrated that the work permits criteria have been satisfied.

The Job

We only issue work permits for jobs that require people with either:

*a UK degree or equivalent or;
*a relevant HND level qualification or;
*a HND level qualification that is not relevant and one years' relevant work experience or;
*at least 3 years relevant work experience that is at NVQ level 3 or above;

Please note that we consider the skill requirements of the job, not the qualifications or experience of the individual to be employed.

The NVQ 3 competence involves the application of knowledge and skills in a broad range of varied work activities performed in a variety of
contexts, most of which are complex and non-routine. There should be considerable responsibility and autonomy, and control and guidance of others is normally required.

We have assessed the qualifications and skills required as stated by you for the post. On this occasion, you have not confirmed or substantiated that the job is at a level of skill and responsibility that qualifies.
Our assessment is based on all the documentation that you have submitted with the application to demonstrate the level of the job, specifically:

*the application form
*job descriptions
*the salary on offer to the employee, which is less than we would normally expect for a job that would qualify for a work permit

Today my employer phoned home office and talked with case worker and got a feedback for rejection is due less salary as compared to roles & responsibilities of my job.

Can you advice me on the appeal process. In addition to this my visa is going to expire in Mid of Oct 2008.

Please assist me ......

Do not appeal but make a fresh application with the increased salary if your employer is willing to do so. For that I believe you need to advertise the position with the increased salary and if employer can not find suitable candidae then you are likely to get WP. I am telling this from my own personal experience. I hired an employee with someK salary and HO refused on the basis that the salary was not enough to warrant a workpermit. I advertised the post, could not find suitable employee and made fresh application and he got the WP.

SAS,

Thanks for your suggestion of filing fresh application for WP1. But my employer will not be willing to improve the salary as it is already compatiable as per the market condition and his budget.

My employer is a small recruitment company based in Scotland, so as per the location (scotland) and company size, employer is already paying me the market rate.

please advise me on this as my employer is completely ready to help me out in this matter (except salary increment).

Seeing as yoi have an MBA & u seem to have some experience, why not just apply for what used to be the HSMP visa? Dunno what it's called now, Tier 1 oe something like that.

One of the things you could do here is to rewrite the jobs specs and ask for skills that only a graduate would have.
