SET-M application - Advice for cohabitation rules - Couple lived apart temporarily

Post by MKC » Mon Feb 17, 2020 10:21 pm

Hi everyone,

My question is regarding the cohabitation rules for SET-M visa type (ILR for spouse). I did a lot of research about it but couldn't find any guidance document on home office website.

My problem is that I lived apart from my husband for 8 months out of the last 2.5 years visa period. I was studying at a university that is 4 hours from our home via public transport and I had 9-5 classes every day. Therefore, the only viable option was campus accommodation.
My husband visited me every weekend during my campus stay and I returned home when I had vacant weeks (half-term etc.).
All my correspondence with NHS, HMRC etc. were still at out joint home, including some utility bills.

I am now worried living apart temporarily may cause a problem. I can hopefully prove that we sustained our relationship by providing bank statements from the period I studied. As he has used his credit cards on or around campus. Would that be satisfactory?

Has there been anyone in a similar situation or does anyone know of any home office guidance document that could help on this issue?

Thank you very much for reading this.

Best regards!
