SET(m): Travel between online submission and priority appointment

Post by pribee86 » Thu Mar 05, 2020 9:05 pm

Hello all

This forum has always been very useful in providing answers for my queries but I can't seem to find a definitive answer to this one so far.

I'm applying for ILR based on 5-year spouse visa route, having completed the required 5 years in December 2019. My current BRP is due to expire on 29 March 2020. I submitted my online SET(M) application on 17 February 2020 and I've booked a super priority appointment on 18 March 2020. I haven't yet uploaded any documents as my appointment is at an enhanced service point which offers document scanning as part of the fee I paid.

We'd like to travel to Portugal between 8 Mar - 15 Mar and I'm wondering if this will cause any problems to my application? I have my passport and BRP, I am within my visa expiry range and will be back 3 days before my appointment.

My 2nd question (more seeking reassurance really) is regarding financial evidence. In my application I have only listed my partner's employment and that he will provide the required payslips, bank statements and employment letter and his income is above the required threshold. I have not made any mention of my income mainly because I have been on maternity leave for the past 10 months and it didn't seem relevant to include any of my employment or financial records (I would be under the income threshold based on maternity payments anyway!) Should I be including anything related to my employment or income at all?

Thank you in advance!

Date of submission of online application is the date of application instead of date of biometrics. So if you will travel then your application will automatically be considered as withdrawn.

Thats fine because you dont need to attach the evidences of that income/source which you arent using.

Hi seagul, thank you for the quick reply.

I refer to a thread here indefinite-leave-to-remain/travel-durin ... l#p1783249 where poster asks if she can travel after online application has been submitted but BEFORE submitting biometrics and another moderator has replied to say yes that's fine.

Given that I'll be submitting my biometrics at my UKVCAS appointment on 18 March, I should be fine to travel before then correct?

Following is the official quote and if you think that you will be alright then you can follow your plans:
34K. Where proof of identity provided under paragraph 34(5) has been returned to the applicant pending a decision on their application for leave to remain and the applicant travels outside the common travel area their application for leave to remain shall, provided that it has not been determined, be treated as withdrawn on the date that the applicant left the common travel area.
