Dependant ILR

Post by Fafa2020 » Sat May 16, 2020 1:07 am

Dear Admin,
Much appreciate the helps you are providing to all of us.
I got Tier 1 Entrepreneur visa (PBS) on the 18th October 2015 and the ILR under accelerated route on the 10th September 2019.
I have a daughter who born on the 30th August 2016 outside the UK, she came to the UK with my wife on the 20 January 2019.
My question is when i can apply ILR for both of them? do they need to complete 5 years to be qualified? is it possible to get citizenship for the daughter after i get it by the end of this year, hopefully.
Thank you and appreciate your reply.

Your wife shall remain under PBS dependant route until she has 5 years for ILR. The non-UK born child will follow her immigration path. A non-UK born child has no automatic entitlement to British citizenship. She can be registered as British when all the following conditions are met: The child must be settled (ILR), you must be British and your wife should be settled (ILR) or should also be applying for citizenship at the same time with her.

Thank you Zimba, much appreciate your reply.
Just to highlight, my wife got the PBS visa with me on October 2015 as dependant and came to the UK for 5 days only at that time, then she stay abroad until January 2019.
Sorry for this point being missed in my original question, but does this make any change to the status?

Thank you again

Original visa was 3 years and four months, so no need to get a new visa, however, the daughter came to the UK under 6 months visa.

What type of visa was your daughter’s? If it was valid for only six months, then has it expired since 20 January 2019?

If their latest visa was under PBS dependant, then she waits until Oct 2020 when she completes her 5 years. The child will follow her as I explained above

PBS dependants do NOT have absence limit unless their visa was issued after 11 Jan 2018.
