SET(M) which 5 year count to apply ILR

Post by baldev42patel » Fri May 29, 2020 9:21 am

Dear expert group members

I need your expert advice!!! which 5 years count to be eligible for SET M application????

Initially i applied FLR(M) in 2015 along with my child without English exam, and they granted 2.5 visa BECAUSE of my child's application along with me. BUT i am not sure they have granted FLR(M)or different category visa.On BRP card it mentioned "leave to remain".On decision letter home office mentioned "because of my particuler circumstences and you have parental relationshipwith a child and it is not reasonabble to expect that child to leave UK."I think it is descretenary leave.

After 2.5 year in 2018 i applied once again for FLR(M) with fulfilling all requirement and English exam and they granted FLR(M). On BRP card it mentioned spouse/partner,leave to remain.

MY QUESTION IS " THIS TOTAL 5 YEAR CAN COMPLETE MY 5 YEAR TO BE ABLE TO APPLY SET(M) APPLICATION???"

Your reply and efforts really really appreciated!!!!!

If you got a visa without proving the English test, you were put on the FLR(FP) parent route and your letter will clearly state which immigration rules you were granted a visa on. You would need to type what the letter says for anyone to offer advice otherwise we are all simply guessing.

If you then switched to FLR(M) meeting the English and Financial requirements in 2018, your clock for ILR on form SET(M) starts at this point. You will therefore need to extend your FLR(M) again for another 2.5 years before you can apply for ILR.

You need 5 years on FLR(M) before you can apply for ILR.
