Child status (Tier-2 dependant) since ILR granted to parents

Post by lelikrambov » Tue Jun 09, 2020 10:51 am

Hello,
I have been granted ILR (my Tier-2 visa was valid until end of July 2020)
My son was born in the UK and has Tier-2 dependant visa (dependant on my visa) until April 2021 (longer than mine because I changed job recently and was issued shorter length visa)

Could I ask several questions please?

1) What happens with status of child when parents granted ILR? Is his visa still valid until it is stated on BRP anyway or it expires as we were granted ILR?
2) It is stated that my son's BRP is expiring in April 2021. But if he is my dependant and I had BRP valid until end of July 2020, does it mean his BRP is valid until end of July 2020 only? We are going to apply for citizenship via MN 1 and I am worried that if we will travel he won't be able to return to the UK as his visa may be expired.

Thank you,
Alex

Nothing happens. The visa remains valid. Presumably you applied for ILR based on 5 years Tier 2?

His visa is valid for the duration it has been issued as indicated on the BRP card.

Child is free to travel while they have a valid visa but must return to the UK while it is still valid.

There shouldn’t be any problems with the MN1 application, as he is entitled to register.
