please help: what can I do now?

Post by jenny2008 » Fri Aug 22, 2008 12:43 pm

Hi,

I am new to this website and appreciate indeed for any reply.

In August 2008, I signed the contract with my employer that my starting date is 1st of September 2008. However, I sent out my Tier1(PSW) application only at the end of July 2008, so it seems very likely it can be returned in the middle of September.

Does anyone have the experience of starting to work while the visa is in processing? Can I ask HR to call HomeOffice to be convinced that it is only a time issue?

Many thanks indeed.
Jenny

Jenny, My wife ( dependent) had a similar issue she showed the letter we received from HO acknowledging the application. And gave the HO contact details and e-mail in case if they want to verify it.

Should not be a major issue I assume since you have already signed the agreement.

In my opinion, whether OP can work (or not) while the Tier 1 (PSW) is under consideration depends on OP's current leave. If the current leave doesn't allow the OP to work full-time (e.g. - as a student), then it might not be possible to start (working full-time) before UKBA makes a (positive) decision on the Tier 1 application.

In your case, your wife was already on dependent visa when you applied for Tier 1 / HSMP extension (you recently received an extension, if I remember correctly) and thus was not restricted from working full-time (on her initial visa).

I suggest that OP checks with UKBA directly.
