hello . i find this platform very informative.
can you please help me with my SAR and long legal residence in Uk.

i came here in October 2010 to December 2011
apply in time spouse visa with British national dec 2011 to granted until may 2014. apply ilr in time may 2014 its pending with HO office until January 2015 during the time we separated HO ask gor interview in mid February 2015 as we separated we didn't not respond to HO .again sent 1 more interview in end of 27 February2015. i decided to withdraw withdraw application 25 of February 2015.
apply new flr fp ( same day apply when i withdraw online) with British child 25 of February 2015 .
(but HO REFUSED my ILR 322 (10) post received 2nd march with right of appeal as i already withdrawel the application but HO send me refusal)
flr fp applied 25 feb 2015 granted in 3may 2015 (10yrs parents route)
now planning to apply set lr long residence in October.
i received my SAR from HO office i share caseworker notes on while flr fp decided.
(> HO didn't update there system yet its still showing on HO system ilr refused with right of appeal and there is also notes of withdrawel ilr 25feb2015 online i don't know how can i sort this out help me guys if u can much appreciated thankyou<)

when HO received my 25feb2015 flr fp application caseworker notes says on SAR .

Immigration Status Requirement
Does the applicant meet the eligibility immigration status requirements? E-LTRPT.3.1 Specify the
applicant's immigration status and whether the requirement is met.

- Applicant applied for leave to remain as a Parent (switching) on the 25 February 2015 and the application
was out of time in breach of immigration rules.
APplicant fails to meet E-LTRPT.3.2.

Ex.1
EX.1
Does the applicant meet the EX.1. requirements? Explain the reasons for meeting/not meeting. If does not
meet EX.1(b) then cross reference to EX.2 re-definition of insurmountable obstacles by quoting 'in
accordance with EX.2
From the information provided the applicant does meet Ex1 to show that he has a genuine and subsisting
relationship with his child in the UK. The applicant has shown he has contact and shared parental
responsibility of the child.
GRANT UNDER THE 10 YEAR PARENT ROUTE:

as HO says flr fp was out of time application and my immigration status was E-LTRPT.3.1. WHAT is it ?
and can i apply set lr in October on 10years basis ?

any help will be much appreciated thankyou so much all of you.

In my view, based on the nature of your immigration circumstances and history, I think it could be of best interest for you to seek an immigration lawyer's advice.
Submitting any future application on you own won't be of great help to you now.
I stand to be corrected.
You might have a good chance of applying for ILR with good advice or covering letter by an immg. Advice explaining your circumstances and situation.

thankyou for reply.
its all done by my solicitor and look like HO messed up all my immigration history.
i asked couple of solicitor but all solicitor looking for money even they don't want to understand the matter .if any body else help me on this platform much appreciated and thankyou.

There was no need to withdraw (you should have varied) but you withdrew the ILR application on 25th Feb 2015 and applied for FLR(FP), making it out of time. It was granted later on under paragraph E-LTRPT.3.1. If you want to read on the details of family life rules check out this guide: https://assets.publishing.service.gov.u ... gov-uk.pdf

You can apply for long residence as the period of overstaying will be disregarded under paragraph 39E.
