ILR for T2 ICT after 10 years long residence

Post by jkk » Tue Jan 28, 2020 1:30 pm

Hi.

I arrived into UK on a T2 ICT on May 2010. And have renewed by T2 ICT a couple of time. I wanted to apply for ILR based on the 10 years residency. A couple of queries :
1. Is it preferred to apply directly ? Or is it better to go through agents.
2. English language : I see that the NARIC assessement needs to be done. But for child who has gone throug education in UK, how do is English language assessed?

Thank you.

Hi There,

Children are exempted from the English language test and life in the UK test.
There is certain complexity around family application for 10 year-long residence application. therefore I would advise finding a good company to prepare your application.

Did your spouse and children come to the UK at the same time i.e. are they completing 10 years together with you too? If it's not the case, they may have to apply separately.

Since I'm in a similar situation, I need clarity on things:

While I'm completing 10 years on 8th Oct this year, the spouse & kids would complete it on 14Feb in 2021.
In this case, how would we apply? Also, since children have completed 7 years in UK, is there any way we can apply altogether?

Regards

1. No advantage to using an agent. They have no influence or special privileges with HO if they help you.

2. All applicants over 18 must meet the English requirement. Either the ho approved B1 test, UK degree or naric English and comparable assessment for a foreign degree. They also need liuk test.

Set LR does not permit dependents to apply with you on the same form. Each person qualifying for 10y ear long residence must complete their own form and meet all the requirements individually.

Thank you very much for your response.

My eldest child is over 18 years and has completed A-levels. Would this mean the English assessment would still be " English Language Test" or is there any alternate to this?

Kind regards

ILR - 10 year long residence - documents from employer

Post by jkk » Mon Jul 20, 2020 9:54 pm

Hi,

I am applying for my ILR after a 10 year stay in the country. I have had my Tier2 ICT renewed multiple times.

All my renewals were done within time and I currently do have leave till next year.

My query is this :

1. My employer is providing me documentation that I am employed, with designation, from when I came in etc. Is this document sufficient? Is it also required to submit earlier COS and applications?

2. My solicitor is very keen to see the records made by my employer into the home office portal (SMS notes into home office). How important or critical is this information?

3. The salary indicated in the COS is only for my fixed part but my actually salary indicates a variable component which is above the fixed part but is variable. Is this going to be an issue?

Request your advice here.

Many thanks.

1. These documents are NOT required for ilr based on long residnece.

2. Not required. You also do NOT need a solicitor for a set LR application.

3. There is NO salary or employment requirment for Set LR.

Do not submit documents that are unnecessary and not required.

Thank you so much for this quick reply. With huge sigh of relief. Thank you.
