ILR and Spouse via

Post by anish_balu » Sat Aug 08, 2020 9:47 pm

Hi Team - I am eligible to apply for ILR in November 2020, my wife's visa is expiring on the same day as mine. Can i apply here tier 2 dependent visa (as she came to UK in NOV 2017 and not eligible for ILR) and my ILR at the same time?

Yes you can. The correct word to use is “PBS dependent extension” not spouse visa.

Although note her application will only be granted after your ILR is successful. But you must apply before her visa expiry.

I am assuming you are going via the Tier 2 route for ILR and not LR.

Also when you apply PBS dependent extension for your wife, its always a good practice to add a cover letter explaining that yourself (the main applicant) has applied for ILR and this application to be considered after your (main applicant) ILR application is processed.
