Hello Everyone, I have been reading this forum and everyone was very helpful. I couldn't find any advice related to my questions so I would like to post a new post. Thanks in advance!

-I got together with my boyfriend in 2016 Dec
-I entered the UK with a Tier 5 Youth Mobility Scheme on Aug 13, 2018.
-My current T5 visa will expire Aug 13, so I submit an application and pay my fee on Jun 5, 2020.

Now I understand that I will need to live with my partner for 2 years. So by Jun 5 2020, I was 2 months short.
However, due to COVID, I still haven't had the chance to submit for document and submit my applications to UKVCAS yet. But recently I have finally receive an invitation to the IDV app. So as of today, I have officially lived with my boyfriend for 2 years and 15 days.

I also plan to submit the following documents as address proof:
When I moved in I didn't have a UK bank account yet, so I don't have a substantial proof in the first few months we live together. I didn't start working until Jan and we took time off and went to travel to Spain, Portugal and Back home between Aug 2018 - Dec 2019. I only have strong official proof from Jan 2019 - Aug 2020.
1. Bank statements
2. Purchases shipped to me in that address (during the first few months)
3. Employment contract
4. letter from my pension company
5. NI Number letter
6. P60

I am from Hong Kong so if this fail I will apply using the new route (BNO for HK citizen route), and if it still fails (very very low chance) then we could get married.


Does the 2 years before application date a strict timeline? Or before submission of document is ok too?
How strong is my application be?

The date of application is the date you submit and pay online and NOT the documentation upload date or the biometric appointment date.

You should have waited and applied only when you met the mandatory 2 years (shortly before your visa expired)living together in a relationship akin to marriage requirement with substantial rock solid evidence in both your names of joint committments etc.

The reason we applied so early because we didn't know 3C leave exists. So we should probably just withdraw our application now? If we appeal to this failed application, would the 2 years of cohabitant date changed to the appeal date?

If you withdraw the application, you become an overstayer as your visa has already expired. Very few visa routes have appeal rights, you might get them, you might not.

Thaks CR001.

So I probably will just have no choice to submit all I have right now and hope for the best. Then worry about appeal or apply for another type of VISA later? :(

For unmarried partner visa ukvi usually perform very rigorous checks and living merely for just 2 years doesn't necessarily fulfill the criteria rather the relationship should have been formed & maintained akin to marriage. For this purpose very robust set of documents are intrinsically be expected to see which in your case isn't seems the case. See what they expect.
