Hello,

I have obtained HSMP in December 2007. I have EC only for one year. As it expires in December 2008 I need to apply for an extension under Tier 1.
I wonder about the previous earnings. I need to claim point for the previous 12 months. I could get points from the salary for maximum 10-11 months as I need to apply at least one month before EC expires. As I remember, in the draft specification of Tier 1 was a difference – if you are under HSMP for less than one year or less than two years - you had to provide salary for 8 or 12 months respectively.

Does anybody have the same situation?

Did you bring this to the notice of the ECO / BHC in your country when the 1 yr. EC was granted to you?

Since you were granted EC in December 2007, you will have to apply for extension under the Tier 1 rules now and there is no provision published in the policy guidance for such a case .. unlike HSMP where it was clearly mentioned that with a 12 month EC an applicant could apply for extension with proof of 8 months' earnings.

Though you could explain the situation in your cover letter and go by the HSMP rules, my suggestion would be to write to BIA explaining your situation and seek advice - since this is no fault of yours.

Thanks for answering. I have not informed ECO / BHC because, as I remember, EC for HSMP was granted for maximum two years, which means two years or less - in my case it is one year.

You do not need to worry.

Just write to the Home Office and explain this thing that you were issued 1 year visa instead of 2 years. BHC in your has done a mistake (error) by not issuing you two yeas visa.

HO will issue you another 1 year visa to bring you in line with all others who hold two years visa (for free of charge, you wont have to pay any fee for this service).

I have personally observed such cases.

Just do as I have told you. You will get it. Success is for granted. If you are still not able to get it done then send me PM for further details.

I have got the replay from HO. They said that I need to contact the Entry Clearance Manager – please find below their answer. Does anybody know what an Entry Clearance Manager is and how to contact this person?

If someone believes there is a mistake on their Entry Clearance visa they should write to the Entry Clearance Manager at the relevant post with full details of their application.
If the post acknowledges there has been an error, they will write to the applicant asking the applicant to submit his/her passport, two photographs and the letter to the following address:
NCC2 EC Errors Team
9th Floor Lunar House
40 Wellesley Road
Croydon
CR9 2BY

Entry Clearance Officer / Manager - one who is authorized to approve issuance of visas at the various British High Commissions in the world.

How to contact ECO - Find the contact details (address) of the BHC in the country where you submitted your EC application. Use this postal address and "Entry Clearance Officer" as the recipient.

Or call / write to the local BHC to get the necessary details (name of ECO, address etc.). I can't say if they will divulge his name to you but you can try.

Hi, not yet. I asked Entry Clearance Manager in my country but I don't have any answer yet. Actually, I sent three emails to ECM but no answer. I sent a mail to HO in UK and they said that will contact ECM in my country (will remaind them). I'm still waiting for an aswer. There are about two months since I first time sent an email to ECM. I'm thinking of complaint. Perhaps this will solve somehow the problem. At least to have an answer from them, to know, whether they accept that this is their error or not.

Hello,

I've just obtained a confirmation (after 3 months of chasing them!!!) from the Embassy in my country that there was an issue with may visa issueing. They confirmed that my visa should have been issued for two years instead of one. Now I need to apply to HO in UK for fixing this issue, i.e. to send my passport to extend my visa for one more year. Does anybody know where should I send my passport together with the letter from Embassy? I tried to find some information on the BA site, but with no chance.
