ILR application document time limit

Hi All:

Thanks for reading this. I have been staying UK since Aug 2015. I work for the University through all the time, but with different type of visa. I used T2 from Aug 2015 to Jan 2016, then changed to T1 (5 years) on Feb 2016 and started to work under my fellowship until Feb 2018 (I was awarded a two years tax-free Royal Society fellowship, but can't use T2 to work under this fellowship). During this time I hold a honorary employment in University. After that, with about one week gap, I was transferred back to normal employment in University with T1 visa until now. I am preparing the application of ILR, but have some questions:

1, As for the two years under my fellowship with T1, I didn't pay tax (so didn't have P60), can this be calculated into continuous stay? Regarding the staying time, am I qualified for ILR now?

2, As there was about one week's gap, does this matters?

3, Do I need to meet the requirement for T2 as well (or only T1 requirement) when I apply ILR?

Thank you very much for you reply. Yes, you are right, it is Tier 1 exceptional talent visa. So the staying time can be added in this case and it is enough now, right? Also, my wife also changed dependant visa from T2 to T1, the continuous staying time for her also can be added in the same way, right?

Time spent under Tier 2 counts. There is no such a thing as Tier 1 or Tier 2 dependant visa (it is the same visa PBS dependant)

My wife have been staying in UK over five years, she initial had the T2 dependent visa(with me as the main applicant) and then changed to Tier 1 dependant with me, since all these dependent visa are PBS dependent visa, so the 5 years for ILR application can be added from Tier 2 dependent visa and Tier 1 dependent visa, right?

Second question, some one can please provide an explanation on this sentence' Does the period of stay on which this application was based include any leave granted since 11 January 2018 '.

It means does she has a PBS dependent visa that was issued or granted on or after 11th January 2018. If the answer is yes, she is subject to the absence limit for any visa issued in or after this date.

My wife's Tier 1 visa was issued on Jan 2015, is that means she doesn't need to meet the requirement that have less than 180 days absence, even if the absence was from the year of 2019? (that why we get confused, as if we answered to for this question, there was no more question for her absence). Thank you very much!

sorry, what I meant is if we answered no, there is no more questions for her absence, that why we get confused. We though my wife need meet this absence requirement even if her visa was issused in Jan 2015.

its not initial visa. its current(recent/latest visa). if it is granted before 11th Jan 2018, then no need to mention the absence details.

Thanks for your reply. My wife had her current visa issued on Jan 2015, but she only had absence in Jan 2019(35 day), so we reply no on this question? Thank you very much!

She cannot have her CURRENT visa issued 5 years ago as a PBS dependent visa is rarely granted for 5 years.

Has she applied for a PBS dependent extension at any point in the last 5 years?

Thanks for your reply. Here is the situation: My wife had Tier 2 dependent visa from Aug 2015 to Jan 2016, then she switched to Tier 1 dependent visa (5 years) on Jan 2016 until now. So Tier 2+ Tier 1 PBS dependent, totally 5 years and 2 months. Our Tier 1 (exceptional talent) visa expiry on Jan 2021.
Is this situation meet the requirement for ILR?

If she doesn't have a current visa issued on or after 11th January 2018, then you answre NO to the question and it is not relevant to her.

Presumably you are applying for ilr at the same time as your dependent.

I just submitted my online application for ILR on 11 Oct, and made the appointment in UKVI on 09 Nov, as we prepared all our supporting documents before we submitted online application, do we need prepare additional document(like payslip, bank statement, updated reference letter) to cover the time between the 11 Oct and 09 Nov, since it is about one month gap between we submitted application and have the appointment?

Thank you very much for your reply. Final questions, since I applied with my dependent, for the living address document, we will submitted it as the evidence of cohabitation. Do I need submit these documents twice to support my application(main application as well) at the same time?

We have prepared two cover letter for both of us, is that necessary?
