ILR dependent - absence calculation

Post by Raja6891 » Mon Oct 05, 2020 11:37 pm

Hi,

I need help to understand 180days absence calculation for ILR dependent visa. Below is visa timeline.

Arrived in UK: 08/09/2015
first extension: 22/08/2016
Second extension: 19/08/2019
Current leave valid until 21/08/2022
Absence from UK : 16 June 2017 - 10 Feb 2018 (239 days)

Am I right in saying that I am eligible to apply ILR since my absence (239 days) was during a period of leave granted prior to 11 January 2018.

Hi,

Thanks for you quick response. another question.
Do I need enter all the absences in past 5 years in ILR application or just absence after 19/08/2019 is enough.

Bcoz I read in another post that absence during a period of leave granted prior to 11 January 2018 need not to be entered in ILR application. is this right?

Thanks for your help.

That is clearly what the question is about in the form, or leave granted in or after 11 January 2018, which is when the rules changes re absence for PBS dependents.

Set(O) or Set(M)

Post by Raja6891 » Wed Oct 28, 2020 11:34 pm

Hi,

I got my British citizenship through Tier 2 - 5 year route.
My Wife has got Tier 2 - PBS dependent visa now and I am applying ILR for her using SET (O) form.
Is SET(O) correct form for PBS dependent or should I use SET (M)?

Please note that when my wife applied for 2nd extension as PBS dependent, I had ILR status.

Thanks.

SET(O)

You already have an existing topic:

Thank you Cullinan. Sorry, yes I raised query about absence calculation earlier.
Thought this was different topic.

Thanks for your help. I got another question. In SET(O) form, there is question on Main applicant's sponsor license number.
My previous company cancelled their license recently. So when I enter the license number in SET(O) form,
it says invalid.

can I skip this question?
