Redundancy and ILR via 10 year route

Post by Zample » Tue Nov 03, 2020 11:30 am

I would like to clarify some doubts I have.
I am on tier 2 ICT visa prior to rules of April 2011. I entered the U.K. on the 09th May 2011. I am looking to apply for my ILR in May 2021 via the 10 year route. I understand the earliest I can apply for my ILR is the 12th April, 2021 i.e. 28 days before my entry. My current visa expires on 23rd May, 2021.
I have been given my redundancy notice and the last day of employment is 24th March, 2021. I understand if I am sent a curtailment letter as soon as the home office is informed, I have 60 days to exit the country or before the date my visa expires which ever is the soonest.
Please can you confirm,
1) if this would be an issue if I go ahead and apply for ILR on the 12th April? Does my redundancy time line cause any issues with my application?
2) Do I need to show a source of income or do I need to be employed at the time of application?
3) My spouse is a dependent and currently employed, will his right to employment be impacted after I am made redundant? Till when he is legally allowed to work?
4) If yes for question 3, can we proceed with his application of ILR dependent with his proof of income since I will not be working?

1) Long residence will not be affected as it is simply based on lawful residence
2) Long residence does not have an employment requirement
3) Your spouse can work normally as long as he has a valid visa
4) He should switch to FLR(M) and yes, his income can be used

Thanks you for your reply. Can we all apply at the same time for our visa.

Yes, but they are separate applications. SET(LR) for you and FLR(M) for him
