ILR - Long Residence Query

Hi All,
Currently I am awaiting for my visa application approval as Tier 2 dependant. This coming February I will complete 9 years and 11 months. My question is as below

Q1. Am I eligible to submit an application for ILR LR before a decision is made on current application?

Q2. As currently there is a active application with HO do I need.to cancel that and then apply or vice versa?

Q3 . Will HO refund the application fee and IHS surcharge that I paid for the dependant visa if I don't get any update until Feb 21?

Q4 . My daughter born in the UK is currently India since Feb 2020 early this year. Her PBS dependant visa expired as of August 2020. Once I get my ILR could I put an application for her citizenship from India?

Yes you can vary your application to LR. It is best to vary when you are eligible i.e. 10 years minus 28 days AND book the biometrics when you complete 10 years (on the safe side)

Q2. As currently there is a active application with HO do I need.to cancel that and then apply or vice versa?
You can simply vary when you are eligible and given a decision is not made on extension application till then. Do not cancel your application as it will be a problem if your current visa is expired. Once you start LR application, the form will ask if you have any pending applications with HO. Mention the extension application details there. Also add a cover letter with your LR application. It will automatically be varied

Q3 . Will HO refund the application fee and IHS surcharge that I paid for the dependant visa if I don't get any update until Feb 21?
As long you vary to LR before a decision is made on your extension application, you will get a refund of extension application fees and IHS

Q4 . My daughter born in the UK is currently India since Feb 2020 early this year. Her PBS dependant visa expired as of August 2020. Once I get my ILR could I put an application for her citizenship from India?

Yes. After you get ILR, you can register your daughter through MN1 route. Your daughter will have to attend biometrics in India with a responsible adult. Once the application is approved, you will be able to apply British Passport for her also.
