I applied and got ILR LR 10 years this week.
My family is on Tier 2 Dependent visas valid until June 2022. They are in UK for 9 years (I was on Tier 2 ICT first). Wife, 16 years old daughter, 23 years old daughter.
The question is if they MUST to apply for new visas now. I was sure their visas are valid until June 2022 and they can apply for ILR (LR) next summer. Not anymore.
Please help!
Can they wait on their current visas for a year and apply next summer for ILR LR?
If not - what kind of visas and how fast should they get?
Regards,
Sergiy

Maybe your plan work well if they won't travel outside of UK.

They are expected to change their visas to FLR(M) as they can not carry on Tier 2 Dep visa after you got ILR via LR. Their visas could be curtailed or they could be refused entry in UK if they travel. Once they switch, their ILR clock will reset to zero for 5 year route.

Based on the information you have provided, your wife will need to apply to switch into the partner of a person who is settled in the UK category under Appendix FM of the Immigration Rules. There is no set time limit in which a dependant partner would have to make their application to ‘switch’. Failure to apply would not be considered as a breach of the Rules, as he or she would still have extant leave, and we would not be looking to curtail that leave unless we were made aware that the relationship had ended. However, it would be advisable for your wife to apply as soon as possible as she will not be able to apply for settlement until she has ‘switched’ into the correct immigration category and completed 5 years continuous leave in that category providing that she meets all the requirements of Appendix FM paragraph R-ILRP.1.1.
Yours sincerely

In doing it lately would deprived the person from ILR (settlement) under 5 years of route instead 10 years of long residence which allows the aggregation of all visas.

Thank you
We are aiming at 10 years LR route. July 2021. But here we have another question (LINKED!).
My wife and elder daughter have an appointment in January 2021 to register with police their Tier 2 dependent visa. All because of COVID. Question - will they (Overseas Visitors Records Office (OVRO) - London) recognise my dependents' visas?
Or is it the same to traveling abroad?

Sergiy

Except travelling for all other purposes, there shouldn't be any issue.
