Tier 2 extension and Ilr Set LR

Hi all,

On behalf of my friend he applied for tier 2 extension in April and still waiting for the reply from UKVI, mean while he lost his job. He will be completing his 10 years on 21st January 2021 (less 28 days).

What are the possible options for him to reach to 10 years without any issues?

If his application remains pending until then, then he can vary the Tier 2 application to SET(LR)

If I am not wrong, your friend will need to apply for a visa within 14 days of refusal for 39E to apply. Else his lawful stay may come to an end.

Then unless his section 3C is extended until he is eligible for long residence (e.g because of AR) then he cannot apply for SET(LR)
