ILR 5yr mixed tiers?

ILR 5yr mixed tiers?

Hi there

The wording on the government site regarding ILR says:

"If you’ve got a family visa as a partner or spouse on the 5-year route, you must have been living in the UK for 5 years.
If you’re on the 2-year route, you must have been living in the UK on that visa for 2 years."

I note that the 2 year route specifies that you have to have been on "that visa" for the 2 years, however the 5 year route doesn't specify five years on that visa - just "living in the UK for five years".

I am on the five year route (and have about 18 months left), but I have been living in the UK for over five years as I spent the first two years on a Tier 5 visa (non-partnership).

Does this mean I'm actually eligible to apply for ILR now? ...
Or is it just poorly worded on the government site?

You will have to complete 60 months on your spouse visa minus 28 days from the first date in entry in UK (or the first issue date if you switched in UK) to qualify for ILR.

Also, tier 5 doesn't count at all towards ilr based on 5 years residence.
