ILR APPLICATION QUERY 2020

Post by Jacobpoole » Thu Dec 31, 2020 7:39 pm

Dear moderators,
I got my ILR in 2018 through Tier 1 (entrepreneur), now my dependents (wife and kids) are eligible to apply for ILR. MY question is that can my children who are 18+ apply/ be added into my wife's main application? there is an option to 'Add another applicant' after filling in the main applicant's (wife's) data.
Kindly, please guide me.

No. Only dependent children can be added. Your 18+ children will have to fill their separate SET(O) form and choose the categories accurately when they start the form.

Extremely obliged for your quick, supportive reply
I will definitely start new applications for my over 18 children. I would also kindly ask for your opinion on the consent forms which we need to sign. From what I've understood:
1. Consent form no.1 is to be signed my my wife for her application and my over 18 children for their respective applications
2. Consent form no.2 is to be signed by ME and my UNDER 18 child who will be added in my wife's application. For the rest of my OVER 18 children I'll sign their forms only.
2. For consent form no. 3 I'm a bit unsure, should I sign it or the applicant whose application is being filled sign it, if I've answered 'NO' for "Is the account with a bank or utility company for which you have supplied information and supporting documentation held jointly by you and other people?" and 'NO' for "Does the account with the bank or utility company for which you have supplied information and supporting documentation relate to another person who is to provide you financial support?". Also do I have to prove that I financially support my wife & my kids (over and under 18) for them to get their ILR? if yes, should I change the answers to the mentioned questions?

Applicants (adults) sign Part 1. You will sign Part 2 and 3 for them if that applies.

For child it is not mandatory - But I always suggest the parent to sign Part 1 on child’s behalf anyways. No harm.

No proof for financial dependence is needed. The Part 3 usually is not for PBS dependents. But it talks about financial support and is a family consent form. So I suggest to sign it anyways. No harm to be on safe side.

Your Child 18+ needs some extra documents as you can read in the thread as stated above.

Thank you once again for your kindness and timely help! Have Always found nothing but help and support here.
Would also just want to know if the passport we’re using to apply for the ILR must have 6 months of eligibility on it before it expires? Is there any such time limit needed on the passport?

(NOTE: I have achieved the settled status/ ILR two years ago by the Tier 1 Entrepreneur route)

Also in the documents checklist of my PBS dependants which is listed at the end of their ILR application, there come up two things.
a) “consent form for HO to request verification checks on [MY NAME] for joint accounts or third party supports”
b) “Declaration signed my [MY NAME] to confirm consent for the HO to request verification checks”
It would be very very kind of you to help me understand the difference between the two.
According to me:
a) refers to the consent forms which I understand, but what about b)?
Is b) talking about the declaration that appears at the end of the application? If so, are they asking me to download the complete application after paying for it, then print it, sign the ‘DECLARATION’ part myself and finally upload it on UKVCAS? Also is the main applicant (my dependant) also required to sign this ‘DECLARATION’ before we upload it on UKVCAS?

Very obliged and higly grateful for your concerted efforts!

Also is it normal that on my wife’s application they’ve asked this question: “ does the period of stay on which this application was based include any leave granted since 11 Jan 2018”?
And in an answer ‘Yes’ to this they’ve asked for her absences outside the uk BUT nothing of such sort appears on my over 18 dependants’ application? Is the absences requirement not for my over 18 kids?

It should be valid on the date of application and biometrics appointment

Ignore (b). Consent form only has 3 parts. Sign accordingly. It is the same.

Hello again, another help of yours is needed please. Could you tell me if it is madatory for my PBS dependants (Tier 1 Entrepreneur route) while applying for their ILR to have a criminal record certificate from their country of first nationality/where they were born? My dependants include my wife, under 18 and over 18 child. Could we skip them?
Thanking you in advance for your help.

Are you adding your over 18 in the same account? Only dependent children can be added.

Your over 18 needs to be in a separate SET(O) account and fill his/her form separately.

Plus he/she needs to prove he/she is not living an independent life.

Thank you, again!
Yes, I applied using separate applications for my over 18 dependants but they only asked for the record of absences from my spouse that is why I asked.
Yes, I have proof that they don’t live independantly, thank you!

Hello just have another query, while submitting my online bank statements for my ILR application do I also need to provide a letter from the bank to confirm the authenticity of the statements?
The statements I’m submitting, do have the name, account number, address of the applicant as well as the date which is one month prior to the date of submission. Is the letter needed too?

Thanks a lot, again!
Also, for the NHS registration document which is to be submitted for my over 18 dependants, is a letter from my surgery, indicating the date of my registration as 2018, enough? The surgery letter does not have ‘NHS’ written on it.
