ILR application query

Post by Bob90 » Sat Nov 28, 2020 8:36 am

Hi, I’m applying ILR next week, I got few question about my visa history before applying.

I came to UK on sponsorship by my employer under 2126 SOC code and the job role undertaking was under shortage occupation list.

After 3 years I looked for a new job and got a job offer by another company and they provided sponsorship under same 2126 SOC code and job role was under shortage occupation list.
And I applied for visa on new sponsorship provided believing everything’s correct as it was well recognised company but unfortunately my visa application got REFUSED saying the job I’m undertaking is not under shortage occupation list and need to conduct labour market test.
But company HR disagree to do the labour market test so I couldn’t challenge the decision and I had to let go the job offer and stay in the current job. And without my mistake I had a refusal history on my visa.
After a year I had applied for VISA extension from the current employer and it was granted successfully.

Now I’ve completed 5 years fully with current employer and ready to apply for ILR set(0).
My question is will the previous VISA REFUSAL would affect the decision positive outcome? I’m very nervous to apply as I’m worried about the refusal history.

Any help would be high appreciated.
Cheers

You should be ok. It's not your fault if RLMT wasn't done properly by the employer. For your peace of mind, you could add a cover letter with your application explaining the same thing & that you didn't have any control over that process apart from using the CoS provided by prospective employer.

Your ILR application is anyway based on your current job and completing 5 years on it so don't worry.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Thanks for the information and this gives me a bit of confidence.
The main reason I’m worried about is I’m working on a Design Engineer role and I applied for other job which was manufacturing engineer role which is different. I tailored my CV to match the role requirements and got through the interview. I’m thinking will this make my case more complicated, I don’t know I may be overthinking.
Thank you!

You are overthinking!!
Yeah I’m sorry for that, I just want to make sure that’s it!

You mean it doesn’t matter what role I applied and visa got refused, until unless I’m with the current sponsor meeting all the ILR requirement?

Thanks

For you to still want the meaning of over thinking to be spelt out then it means you are seriously overthinking. You were advised appropriately and explained to by srw so go ahead with your application.
