ILR through Long residence - Will i qualify?

Post by red_dragon » Sun Feb 21, 2021 4:30 pm

Hello All,

I am Indian national, Please help me understand my ILR eligibility

1. Entry to UK - 22 August 2014 on Tier 2 ICT VISA valid from 31-July-2014 until 13-August-2019
2. Wife and 2.2 Year old daugther arrive in UK 2 weeks later on 10-Sept 2014 and have been with me in UK since then.
3. Made few trips to India until 2019 June, on a average 3 weeks per year, visiting family.
4. Went to India in May 2019 to move to Tier 2 General dependent, spouse got a sponsor.
5. Returned to UK in June 2019 as Tier 2 general Dependent, valid until June 2022.

Now we are deciding, may be I will become main visa holder by asking my employer to sponsor me (they have verbally agreed for now) as my wife wants to take a break of couple of years. We are planning to get 3 year Skilled worker visa next year, which should be valid until June 2025.

It all seems to me a straight forward case for ILR through Long residence in August 2024, However i have few questions -

1. Am i right in assuming that I will be eligible for ILR through long residence in August 2024?
2. Wife and Daughter will be eligible for ILR through long residence in Sept 2024?
3. Does it make any difference what route we choose for ILR? if it does my wife can continue for her current employer till June 2024 (on her tier 2 general visa) and we apply then?

Many Thanks.

1. Yes assuming the long residence route still exists in 2024 and nothing changes
2. Yes
3. The long residence may be abolished in the future. No one can know. The skilled visa route may be slightly safer

Thank you very much for your response Zimba.

What makes you say that LR ILR route may be abolished? Is there any news/discussions around this?

There has never been any discussion but the rules change regularly. No one knows what can happen in the future. I just had to remind you that planning from now for 2024 is a kind of farfetched
