Tier 2 Dependant to apply for ILR

Post by expat_uk » Wed Oct 28, 2020 1:54 pm

Hi hope someone can help me,
Partner already ILR via Tier2
Me and 1 child (11 years old) will be ready to apply for ILR.
My questions are:

1. Is it the same form for me and child - Set O?
2. Do I need maintenance funds? if yes how much? I've been in furlough since March and originally with 9 hours contract but now starting Nov will be in zero contract. So probably no payslip to submit as I don't have any rotas yet for the coming month. Is my partner payslip will be good enough?
3. If not can I used my help to buy ISA as my maintenance fund?

TIA

1. Yes, one application for both
2. No maintenance or salary is required for ILR

Thanks for your quick response. just want to be clear no maintenance fund but do I need to submit payslip? If yes what will be my option if I don't have any rotas for November and December because we were planning to apply on January 2021?

Nothing like that needed for a Tier 2 Dep.

Tier 2 partner can I apply first to ILR before my child

Post by expat_uk » Sun Feb 21, 2021 10:57 pm

Hi this is my case
Partner already ILR
I can apply for ILR anytime now. My question is do I need to apply together with my 10 year old child or can I apply first then the child later this year?
I’m also confused in me and partner both ILR does the child can apply straight to citizenship instead of ILR? So less payment? Child born outside UK

Thanks in advance

Apply together using one SET(O) application. Only UK born children have entitlement to register as British after one parent settles. Such a child does not even need ILR.

Non-UK born children have no automatic entitlement to citizenship. For registration by discretion, such a child must hold ILR and at least one parent must be a citizen and the other must be at least settled.
