Financial Documents from Sole trader (husband)

Post by Jos78 » Tue Feb 23, 2021 9:51 pm

Hi,

I obtained my ILR 4 years ago, and my wife's FLR expires in the first week of march and is planning to submit her application this week.
I operate my business as a sole trader and my wife has been working in my business as a full time and permanent basis
and she has been paid £26,000 per annum on her bank account. We have two kids both born in the UK holding UK passports.

I would be really thankful if you could advise me on the following as I am confused with different opinions on the required
financial documents. The salary slips are provided in my sole trader letterhead.

My wife had extended her 2nd FLR for 2.5 years as same working in my business and using salary slips and bank statements.

1. She can submit last six months salary slips & bank statements.
2. should I (husband and the sole trader) submit my income details / account details?
such as SA302 for the year 2019/2020 with profit £22000 as I don’t have this year financial report ready yet.
3. If I should submit any please advise me the details.
4. can I show my bank statements from my personal savings account.

Thanks again

For those self-employed as a sole trader cannot use their payroll salaries as proof of income for ILR under the family route. They are instead required to supply annual self-assessment tax return and other evidence to prove their income (under category F or G)

The guide says this about limited companies, I am not sure if this applies to employees of sole traders:
Where a person is either a director or employee of a limited company in the UK, or
both and receives a salary from that company, that salaried income can be counted
under Category A or Category B, provided that the limited company is not of a type
specified in paragraph 9(a) of Appendix FM-SE (in that it is not in sole or limited
family ownership
)

Read the Appendix FM guide: https://assets.publishing.service.gov.u ... gov-uk.pdf

Search for Sole trader, partner or franchise – specified evidence
