If Tier 1 Appl rejected 4 proof of Accommodation, pls post.

Post by FLO » Mon Sep 29, 2008 10:56 pm

There have been series of controversies on issue of proof of accommodation by Tier 1(General) applicants.
Many believe it is not required as long as u meet the maintenance fund standards ,while other on the other hands believe it has to be there even with enough maintenance fund.
Well, I feel we can get the true situation by inviting anybody whose Tier 1 application has been rejected solely because of not putting proof of accommodation to post here.
If posting, kindly let us know the country of application.
Thank u.

There is nothing complex about this issue. Whether or not you need proof of accomodation depends on which BHC you are applying to, as some have different requirements to others. This is why some applicants say that it is not required, while others say that it is. Different BJCs, different rules. Applicants simply need to take care to familiarise themselves with the requirements of the BHC they intend to apply to and provide the information required.

As per the guidelines proof of accommodation is not a required. BHC cannot reject the application solely because the proof of accommodation was not provided.

I understand your point but consider that you are incorrect. While proof of accomodation is not expressly stated as a documentary requirement for the Tier 1 visa, there are a number of separate enquiries that caseworkers are always entitled to make before granting an applicant a visa. The question "where will you be staying when you arrive?" is one such enquiry. Some BHCs appear to have a standard policy of asking this question (and requiring proof) before granting visas.

Do not forget that caseworkers have discretion when considering applications. As such, applicants would be unwise to adopt the assumption that they are somehow entitled to a visa just because they have provided a particular set of documents.

I would agree that one should not make assumption. Casework might be entitled to check many other aspects but proof of accomodation cannot be sole reason to reject an application... Anyway we are discussing thing which we are not sure of...

Where in the VAF9 form does one have to answer the above highlighted question?

I am pretty sure that one does not have to provide these details anymore. They were needed on the old application form.

Hi All,

My opinion is that it is better to include all the required docs including evidence of accomodation. At least you have a settled mind. "What is worth doing at all is worth doing well". If the CW or ECO rejects you based on that without "a right to appeal" - what can you do about that? A stitch in time saves Nine.

Cheers

I quite agree with the above statement bcs the guideline is the reference for both applicants and case workers particularly in the current Point Based System(PBS). If it were to be in the former HSMP where the conditions for granting EC were not explicit, the case worker might use his discretion to assess application. Tier 1(General) has very clear requirement to score points under each section. It was also stated that submission of irrelevant additional documents may delay the decision making.
If all requirement as in the policy guidelines are strictly met and still the application is rejected, there will be a very good ground for administrative review.
All thesame I am still waiting for those whose Tier 1 applications were rejected based on proof of accommodation. This will clear a lot of issues.I appreciate the intelligent contributions of all mates. You are all wonderful.

I want to thank all the mates who have contributed to this topic, since I kept it opened. As at today, over 400 people viewed the post and no single mate could say that he was denied Tier 1 visa for lack of accommodation proof.
This has demonstrated that the BHC follows the guidance policy that states clearly that proof of accommodation is not req 4 Tier 1 PBS.
So, one can say that the staff of some Visa Application Centres who have requested this did probably due to ignorance.
To me, I believe the requirement for tier 1 applications are very explicit.I wish all Tier 1 aspirants success in their applications.

I got Invitation letter from my friend in UK in september end and I am planning to apply for EC most probably in Mid/End of November or may be in December beginning.

So, will it be OK, if I submit 2/3 months old "Invitation letter" for EC, or should I get a fresh one from my friend in November/December before I am applying for EC ??
