Vary FLR(M) extension to SET(LR)

Hi all,

Thanks for all the effort in maintaining this great resource. I'm wondering if someone could point me in the right direction.

I've been in the UK for approximately 15 years on a variety of different visa, most recently on FLR(M) for the past 2.5 years. My latest grant of leave expired earlier this year and I submitted an application to extend in time - it's being considered at the moment, so I understand my leave is extended by virtue of section 3c.

In the time since my latest application, I believe I have become eligible for long residence ILR - the issue previously was too many days spent outside of the UK.

Would I be able to change my application to SET(LR) and would that result in cancelling my FLR(M) extension if for whatever reason the SET(LR) was refused?

If you vary a previous application, then your application is considered amended as if you originally applied for SET(LR). There will be no extension application. That is because two parallel applications cannot exist under the law. A new application will always be considered a variation of the pending one
