Main applicant eligible for ILR, dependents need Tier 2 PBS extension

Post by lazyyy » Wed Jun 30, 2021 12:02 pm

Hi everyone,
I am eligible for ILR in September 2021 via the Tier 2 PBS 5-year route. However, my wife and 2 kids (14 and 16 years old) are on a Tier 2 PBS dependent via and they will complete 5 years on this visa by February 2022. I have the following questions:
1. Can I apply for ILR first (28 days before expiry of my Tier 2 visa) through the same day service and then if my application for ILR is approved, apply for extension of the Tier 2 visa for my dependents? Or do they have to be submitted concurrently ?
2. Do I really need to apply for Tier 2 visa extension for my kids? Or can they apply for ILR once my ILR application is approved?
3. What will I need from my employer to include within my ILR application as well for applying for Tier 2 extension? Will I need a CoS again from my employer to include within my dependents application?
4. Is there a handy list of documents somewhere on this website that I can look at for preparing my ILR application?

Thanks a lot

1. Extension can be applied later and when their visa is about to run out.
2. Non-UK born children will follow the immigration path of the less privileged parent. They cannot get ILR with you or because of you.
3. Their extension has nothing to do with your employer. You need an employer letter for your own ILR
4. You will be given a list after submitting your application

Hi Zimba,
Thanks for such a prompt and accurate reply. Just one more follow up question:
1. So the employer letter would be enough and I would not need a CoS or similar requirements for my own ILR?
Do I need to ask the employer to mention anything specific within their letter?

Thanks and it is amazing the kind of help and advice you are offering.

The sponsor must confirm they require the applicant to work for
them for the foreseeable future, and the applicant will be paid at least the minimum
salary in paragraph SW 24.3. for the foreseeable future. The sponsor should not
assign a new CoS for this purpose – an e-mail or letter is sufficient, as long as it can
be verified with the sponsor if necessary.
