Daughter's Visa renewal- ILR?

Post by binoyjoseph » Mon Nov 01, 2021 12:08 pm

Hi board members,

My daughter was born in India in Dec2017, and I was on Tier2 visa then, and my wife was on Dependant visa on me. While I have got my British passport through naturalisation this year-2021, my wife applied for ILR and have received it. My daughter's visa expires in Feb-22 and was planning to renew. Can you please guide me in understanding if I can apply for ILR visa for my daughter since my wife has an ILR?.

Thanks,
Binoy

Your wife and daughter could have applied for ILR together in one application. Why didn’t you include her in the application ?? Is it because you incorrectly thought she also needs 5 years of residence in the UK ??

Children do not have a min residence period requirement at all. They can settled when both parents are settled :!:

If your wife settled via SET(O), then apply for your daughter using SET(O). If your wife applied under the long residence, then use SET(F) for your daughter
